These Terms and Conditions ("Terms") govern your use of the SnekUp mobile and/or web application and website (the "Service") operated by Omorsoft Ltd ("Company", "we", "us", or "our"), a company registered in the United Kingdom with its registered office at 86-90 Paul Street,London EC2A 4NE, UK.

By using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use our Service.

1. Definitions

• "App" refers to the SnekUp snakes management mobile and/or web application developed and operated by Omorsoft Ltd.
• "User" refers to any individual who accesses or uses the Service.
• "Content" refers to any data, text, images, or other material uploaded or entered by the User.

2. Eligibility

You must be at least 13 years old to use our Service. If you are under 18, you must have parental or guardian consent.

3. Account Registration and Use

• You must create an account to access certain features of the App.
• You are responsible for maintaining the confidentiality of your login credentials.
• You agree not to impersonate another person or provide false information.

4. Subscription Tiers and Billing

• The App includes a free tier ("Hatchling") for users managing one snake.
• Paid subscriptions ("Juvenile" and "Adult") offer management of more snakes.
• Prices are displayed in your local currency and are subject to change.
• Subscriptions renew automatically unless canceled before the billing date.
• You may cancel at any time through your platform's subscription settings.

5. Use of the Service

You agree not to:

• Use the App for any unlawful purpose.
• Modify, reverse-engineer, or attempt to extract the source code of the App.
• Interfere with the operation of the Service or attempt to gain unauthorized access.

6. Intellectual Property

• All content, design, graphics, and functionality are owned by or licensed to Omorsoft Ltd.
• You may not copy, distribute, or create derivative works without written permission.

7. User Content

• You retain ownership of any data you upload.
• By uploading content, you grant Omorsoft Ltd a non-exclusive license to use, store, and display the content to operate the Service.

8. QR Code Functionality

• The App allows you to generate and scan QR codes to quickly log snake activities.
• We are not responsible for misuse, inaccuracy, or errors caused by QR scanning.

9. Disclaimers

• The App is not a substitute for veterinary advice.
• The App is provided "as is" without warranties of any kind.
• We do not guarantee that the Service will be error-free or uninterrupted.
• This includes, but is not limited to, animal husbandry and care data contained in the Service.

10. Animal Care Information and Liability Disclaimer

The information provided in the Service, including but not limited to husbandry data (such as temperature ranges, humidity ranges, UVB recommendations, feeding schedules and species care information), is provided for general reference and educational purposes only. While Omorsoft Ltd endeavours to ensure the accuracy of this data, individual animals’ needs and environmental conditions vary. You should not rely solely on this information for health or care decisions. By using the Service, you agree that any resulting decisions or actions are taken at your own risk. Omorsoft Ltd, its affiliates, directors, employees and licensors accept no responsibility or liability for injury, illness, death, loss of property or financial loss arising from use or misuse of the information in the Service. Users are encouraged to verify care requirements through other reputable sources e.g. experienced keepers, veterinarians etc.

11. Limitation of Liability

To the fullest extent permitted by law:

• Omorsoft Ltd shall not be liable for any indirect, incidental, or consequential damages.
• Our total liability shall not exceed the amount paid by you in the last 12 months.

12. Termination

We may suspend or terminate your access if you violate these Terms.

You may terminate your account at any time through the App settings.

13. Changes to Terms

Omorsoft Ltd may update or modify these Terms & Conditions from time to time. Any changes will take effect upon being published on the SnekUp website or within the app. Continued use of SnekUp after such changes constitutes your acceptance of the revised Terms.

14. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
